Involuntary Transfer and Reassignments

The Superintendent may, with the approval of the Governing Board transfer an employee to another position in the same classification when the transfer will, in the Superintendent's opinion, be in the best interest of the district.

A management employee transferred under these rules may request a statement of the reasons for the transfer, and the request shall be granted.

Involuntary reassignment to a lower management position may become necessary in the event of decreasing enrollment, cancellation or reduction of a particular program or lack of district operating funds. Such reduction of position must be made with appropriate and timely prior notice and shall be without prejudice against the employee.

A management employee who is reassigned to teaching because of decreasing enrollment, cancellation or reduction of a particular program, or lack of district operating funds will have seniority as a teacher as though the years spent in management were spent in teaching.

(cf. 4113.2/4213.2 - Promotion/Demotion)

When an employee transfers from an administrative position to a teaching assignment, the period of time served as an administrator will not be included in the computation of seniority as a teacher, for the purposes of layoff. School site administrators shall accumulate a maximum of three years seniority while serving in that capacity.
