Site-Level Positive Behavior Plans

In developing site-level Positive Behavior Plans, the principal or designee shall solicit the participation, views, and advice of one representative selected by each of the following groups: (Education Code 35291.5)

1. Parents/guardians

2. Teachers

3. School administrators

4. School security personnel, if any

5. For junior high and high schools, students enrolled in the school

This plan should be developed and reviewed with the School Site Safety Plan and submitted annually for Governing Board approval.

Disciplinary strategies provided in Board policy, administrative regulation, and law may be used in developing site-level Positive Behavior Plans. These strategies include, but are not limited to:

1. Referral of the student for advise and counseling

2. Discussion or conference with parents/guardians

3. Recess restriction

4. Detention during and after school hours

5. In accordance with Board policy and administrative regulation, restriction or disqualification from participation in extracurricular Activities)

7. Reassignment to an alternative educational environment

8. Suspension and expulsion in accordance with law, Board policy, and administrative regulation

The Positive Behavior Plan shall be consistent with law, Board policy, and district regulations. The Board may review, at an open meeting, the approved school plan for consistency with Board policy and state law. (Education Code 35291.5)

It shall be the duty of each employee of the school to enforce the school Positive Behavior Plan. (Education Code 35291)

Detention After School

Students may be detained for disciplinary reasons up to one hour after the close of the maximum school day. (5 CCR, 353) It shall be the responsibility of the certificated staff members, responsible for the after school detention, to contact the parent/guardian prior to the implementation of the detention.

If a student will miss his/her school bus on account of being detained after school, or if the student is not transported by school bus, the principal or designee shall notify parents/guardians of the detention at least one day in advance so that alternative transportation arrangements may be made. The student shall not be detained unless the principal or designee notifies the parent/guardian.

In cases where the school bus departs more than one hour after the end of the school day, students may be detained until the bus departs. (5 CCR 307, 353)

Students shall remain under the supervision of a certificated employee during the period of detention.

Students may be offered the choice of serving their detention on Saturday rather than after school.

Community Service

As part of or instead of disciplinary action, the Board, Superintendent, principal, or principal's designee may, at his/her discretion, require a student to perform community service during nonschool hours, on school grounds, or, with written permission of the student's parent/guardian, off school grounds. Such service may include, but is not limited to, community or school outdoor beautification, campus betterment, and teacher, peer, or youth assistance programs. (Education Code 48900.6)

This community service option is not available for a student who has been suspended, pending expulsion, pursuant to Education Code 48915. However, if the recommended expulsion is not implemented or the expulsion itself is suspended, then a student may be required to perform community service for the resulting suspension. Corporal Punishment

Corporal punishment shall not be used as a disciplinary measure against any student.

Corporal punishment includes the willful infliction of, or willfully causing the infliction of, physical pain on a student. (Education Code 49001)

Corporal punishment does not include any pain or discomfort suffered by a student as a result of his/her voluntary participation in an athletic or other recreational competition or activity. In addition, an employee's use of force that is reasonable and necessary to protect himself/herself, students, staff, or other persons, to prevent damage to property, or to obtain possession of weapons or other dangerous objects within the control of the student is not corporal punishment. Systematic Approach to Discipline

The adoption of the Board Policy establishes a framework for developing, refining and implementing a culture of behavior conducive to learning. School-wide positive behavior support is based on research that indicates that the most effective discipline systems are proactive in use of strategies developed to prevent discipline issues. Before a student receives consequences for inappropriate behavior, they must first be instructed in learning the necessary skills to enhance the positive school climate and to avoid negative behavior. When inappropriate behavior does occur, consequences will be appropriate. The plan shall be monitored going forward and on an ongoing basis. Practices shall be equitable, fairly implemented, non-discriminatory and culturally responsive.

The successful development and implementation of the discipline policy rests with every member of the school community. This includes students, parents/guardians, teachers, administrators, school support staff, school staff, and central office staff, visitors and community members involved in education activities or support. The roles and activities include:

мя Supporting school-wide positive behavior and discipline plans consistent with district policy

мя Knowing, communicating and monitoring the implementation of the policy Open lines of communication between all members of the school community

мя Use of positive response strategies and appropriate feedback to correct and deal with disruptive students

мя Collaboration with after-school programs

мя Fostering and supporting partnerships with local, regional and state agencies including law enforcement, mental health, social services and judicial system

Responsibilities

Students:

мя Students are expected to learn and model local school behavioral standards and expectations

мя Students are expected to learn and follow all school and classroom rules and to demonstrate appropriate social skills when interacting with both adults and peers

мя When behavioral expectations are not met, the student is expected to work to improve behavior

мя Students are encouraged to take leadership roles in modeling appropriate behaviors and attitudes for peers

Parents/Guardians/Caregivers:

мя Parents/Guardians/Caregivers will take an active role in supporting the school's efforts to maintain a welcoming school climate. This includes supporting the implementation of the school-wide positive behavior support and discipline plan

мя Review and understand the Parent Student Handbook

мя They are to be familiar with school rules and expectations and review them with their children, reinforce positive behavior, and acknowledge their children for demonstrating appropriate behavior

мя If misconduct escalates, the parent/guardian/caregiver will work with the school as a collaborative partner to address the student's needs

мя It is mandated that training be available for parents/guardians/caregivers on this policy

Teachers:

мя Develop, support and maintain a positive classroom and school environment

мя Use of effective classroom management strategies to create an environment conducive to learning and prevent misconduct

мя Teach and review classroom and school rules and the school-wide discipline plan

мя Acknowledging and reinforcing appropriate student behavior

мя Providing corrective feedback and re-teaching the behavioral skill when misconduct occurs

мя Work in partnership with families to reinforce appropriate behavior including communicating with families through meetings, phone conferences, email, correspondence, and utilizing other resources as available and appropriate

мя Teach the school district or state-approved violence prevention curriculum that develops social-emotional skills

мя Follow the behavior support plan for students with disabilities

мя Utilize data in collaboration with administration and support personnel to monitor misconduct

мя Report inappropriate behavior (in accordance with the school-wide plan) to the school administrator or person responsible for discipline at the school site for a student who engages in ongoing misconduct, despite appropriate interventions

School Administrators:

мя Serve as a role model and a leader

мя Work in collaboration with all school staff and with community support to establish a caring school climate and safe environment

мя Ensure that the district policy and school-wide discipline and behavior expectations will be taught, enforced, advocated, communicated and modeled to the entire school community, and that school practices are consistent with the tenets of this policy

мя Issue a written invitation to all stakeholders (including parents/guardians, teachers, classified administrators, community agencies, and students) to participate in a school-wide discipline leadership team, under the auspices of the School Safety Plan. The team will assist in monitoring the implementation of the school-wide positive behavior support plan

мя Ensure that the development and implementation of a school-wide positive behavior support and discipline plan is consistent with district policy

мя Implement the recording, collecting and analyzing behavior/discipline information in order to monitor and evaluate data for ongoing decision making from the individual student through the school-wide student population

мя Provide training and support for staff and parents/guardians/caregivers in maintaining an environment conducive to learning

мя Provide prevention, intervention programs/activities regarding student conduct, character building, school site expectations

мя Create behavioral contracts and monitor progress as an alternative to further disciplinary action

мя Implement the district or state-approved violence prevention curriculum in elementary and middle schools

мя Consistently utilize reasonable alternatives to suspension

мя Use of multi-disciplinary teams, including SST, MHIT, SART and SARB, establish behavior contracts to evaluate and recommend solutions to behavior problems

мя Establish behavior contracts

мя Collaboration and partnerships with after-school programs and outside agencies, when appropriate

мя Assemble a collaborative team with appropriate staff and the parent/guardian/

caregiver(s) to address the escalated behaviors for a student who engages in ongoing misconduct, despite appropriate interventions, and design and implement an effective individualized behavior support plan that may include, but is not limited to:

мя Intensive behavioral supports and strategies

мя Adapted curriculum and instruction

мя Communication strategies

School Support Personnel:

мя Support the implementation of a school-wide positive behavior and discipline plan to maintain a safe and nurturing school climate

мя Monitor, reinforce and acknowledge appropriate behaviors

мя Assist students in accessing appropriate resources, directly matching student needs to available resources

мя When student behavior disrupts the learning or working environment, the appropriate school support personnel will work collaboratively with teachers and other school and district personnel to develop and implement plans for more intensive instruction and support, which includes working with district and community resources

School Staff:

мя Foster a positive school climate

мя School staff is responsible for teaching, enforcing, advocating and modeling the district policy for student behavior

мя Support the implementation of a school-wide positive behavior support and discipline plan to maintain a safe and nurturing school climate

мя Each staff member shall monitor, reinforce and acknowledge appropriate behaviors and the school rules, and provide positive corrective feedback for any misconduct

мя School staff shall be engaged in supervisory responsibilities and should be particularly aware of the important role that they have in maintaining and supporting appropriate student behavior

мя Be knowledgeable of behavior support plans for students with disabilities

District:

мя The Superintendent (or designee) shall be responsible for enforcing, advocating and modeling this policy to district staff and school administrators

мя The Superintendent (or designee) shall designate a team of district administrators, who shall ensure the successful implementation of and ongoing compliance with this policy through support and guidance

мя District staff, in collaboration with school-site staffs, shall also be responsible for taking an active role in providing appropriate support and technical assistance to schools to:

мя Identify, develop and maintain prevention and intervention activities

мя Analyze data, monitor and evaluate school practices in order to address situations where practices need to be strengthened

мя Develop on-site procedural steps to assist with choices and options when addressing individual student misconduct

мя Broaden the adoption and implementation of alternatives to suspension

мя Oversee schools' efforts to maintain relationships with outside community partners

мя Utilize data in the allocation and provision of base professional development in school-wide positive behavior support for any new staff (or designee)

Superintendent:

мя Communicate to all district staff, using a variety of means, that creating a positive school culture, improving behavior and developing appropriate student discipline practices are top district priority

мя Develop and coordinate training for parents/guardians, behavior seminars for students and professional development for all employees

мя Ensure appropriate data collection, monitoring and evaluation systems

мя Develop and provide a Resource Guide to assist schools in utilizing and coordinating programs and resources

мя Coordinating and providing technical assistance, including the proactive alignment of instructional supports with behavioral supports

мя Use systematic data analysis to determine needs for more supports and improved alternative education options

мя Ensure alignment with all district offices, programs, policies and initiatives

Visitors:

мя It is expected that all visitors will act in accordance with district policy and Guidelines while on district property and at district or school-sponsored activities or events

Community Members:

мя The community benefits from safe schools and members are expected to follow district policy and Guidelines when on school property

мя Community partnerships are encouraged and welcomed in the development of reinforcements for appropriate student behavior and recognition of a safe school environment

Notice to Parents/Guardians and Students

At the beginning of the school year, the Superintendent or designee shall notify parents/guardians, in writing, about the availability of district rules related to discipline. (Education Code 35291, 48980)

The Superintendent or designee shall also provide written notice of the rules related to discipline to transfer students at the time of their enrollment in the district.
