Disciplinary Action Of Classified Management, Supervisory And Confidential Personnel
Causes for Disciplinary Action
An employee may be subject to disciplinary action for any of the following causes:
1. Incompetence.
2. Inefficiency.
3. Unauthorized absence, habitual tardiness or absence, or abuse of leave privileges.
4. Intoxication, being under the influence of, or use intoxicants or illegal State and Federal regulations.
5. Use of narcotics, except under a physician's direction if not in conflict with State and Federal regulations.
6. Insubordination or insolence of disrespect toward authority.
7. Dishonesty.
8. Conviction for a felony offense, any crime of moral turpitude, or any crime bringing discredit upon the district.
9. Immoral conduct which affects or impacts employment.
10. Evident unfitness for service.
11. Physical or mental condition unfitting the employee for service.
12. Violation of or refusal to obey the school laws of the State or policies and regulations of the district.
13. Disloyalty to the district, meaning conduct which harms the interests of the district for the purpose of inappropriately benefiting the employee.
14. Advocacy, or membership in a Communist Party or any other organization which advocates overthrow of Federal, State, or local government by force, violence, or other unlawful means.
15. Falsification of any district document or submission of any falsified or misleading information to the district, including, but not limited to, information supplied on an employment application.
16. Excessive garnishment of wages, not including child support payment.
17. Abandonment of position, including failure to return to duty upon expiration of any authorized leave of absence, or failure to report to duty for three or more working days without prior notification and authorization for such absence.
18. Inattention to or dereliction of duty.
19. Negligent or willful damage to district property or waste of district supplies or equipment; unauthorized use of district property for private purposes.
20. Engaging in unauthorized political activity during assigned hours of employment or otherwise in violation of applicable regulations or policies of the district.
21. Arrest for a sex offense as defined in Education Code Section 44010 (suspension); conviction for a sex offense (dismissal).
22. Conviction for a controlled substance offense as defined in Education Code Section 44011.
23. Discourteous, offensive or abusive conduct or language towards other employees, students or the public.
24. Unauthorized release of confidential information, as defined by law, from district records.
25. Unauthorized signing in or out for other employees.
26. Excessive or inappropriate fraternizing with students
27. Possession of unauthorized, dangerous and/or deadly weapons on district property.
28. Consecutive evaluation ratings below acceptable district standards.
29. Inability to perform assigned duties due to failure to meet job qualification, including, but not limited to, failure to possess required licenses, failure to pass required tests, or failure to meet standard risk insurability requirements.
30. Such other causes as are determined by the Board to be sufficient cause for disciplinary action.
Procedures for Disciplinary Action
The district shall follow procedures prescribed which afford each classified manager, supervisor, and confidential employee the due process rights afforded by law.
