Identification, Evaluation And Education Under Section 504

It is the responsibility of the district to identify and evaluate students who, within the intent of Section 504 of the Rehabilitation Act of 1973 (Section 504), require a free appropriate public education in the form of regular or special education and/or related aids and services designed to meet their individual needs as adequately as the needs of non-disabled students are met. For this policy, a student who is eligible for a free appropriate public education pursuant to Section 504 is defined as one who has a physical or mental impairment that substantially limits one or more major life activities, including learning.

Students may be eligible for services under the provisions of Section 504 even though they do not require services pursuant to the Individuals with Disabilities Education Act (IDEA). Students who are identified as individuals with a disability, according to the IDEA criteria, are not addressed under this policy. The needs of such students are provided for under Board Policy 6164.4.
