Determination of need not required for previously approved expansion
The determination of need, as required by this chapter, shall not be applicable to the initiation or expansion of a program to the extent previously approved and implemented prior to November 23, 1970, or with respect to expansion of a program to maximize the utilization of facilities acquired or approved for acquisition prior to November 23, 1970.
