Students Expelled From Other Districts

The Board shall hold a hearing whenever it finds that a new resident seeking enrollment was expelled from another district for any of the following acts: (Education Code 48915)

1. Causing serious physical injury to another person, except in self-defense.

2. Possession of any firearm, knife, explosive or other dangerous object of no reasonable use to the student at school or on school grounds.

3. Unlawful sale of any controlled substance, as listed in Chapter 2 (commencing with Section 11053) of Division 10柯f the Health and Safety Code, except for the first offense for the sale of not more than one avoirdupois ounce of marijuana, other than concentrated cannabis.

4. Robbery or extortion.

The hearing and notice shall be conducted in accordance with expulsion procedures.

If the student or parent/guardian neglects to inform the district of the student's status with his/her previous district, the Board will record and discuss this matter during the hearing. (Education Code 48915.1)

Upon determining, at this hearing, whether the individual in question poses potential danger to district students or employees, the Board shall either deny enrollment for the remainder of the expulsion period, permit enrollment, or permit conditional enrollment. If the student is found not to pose a danger and now resides in the district, he/she shall be admitted or conditionally admitted.

Students who have been expelled from other districts, who are not new residents, shall not be permitted to enroll in our District.
