Risk Management, Insurance And Indemnity Protection

To the extent reasonable under all circumstances, the district's property and operations shall be supervised, managed, and directed in a manner that minimizes risk and liability exposures, protects district property and resources, and promotes the overall health and safety of students, employees, and members of the public.

The Governing Board shall direct the purchase and maintenance of insurance coverage or indemnity protection provided by a joint powers authority (Government Code Section 6500, et seq.), or appropriately funded self-insured coverage, that provides the district, its employees, and its volunteers with general liability, automobile liability, professional liability, fiduciary liability, directors and officers liability, and first party property coverage.

The provided coverage, limits of liability, and the terms and conditions of coverage, shall be regularly reviewed to ensure that they comply with the district's legal and contractual obligations and are prudent and appropriate given the district's current risk exposures and needs.

The Superintendent shall maintain an efficient risk management and claims handling system in order to reduce district exposures costs, facilitate communications with coverage providers, transfer risk exposures to third parties when reasonable and appropriate to do so, take advantage of provided trainings and support services, and to facilitate notice of claims and compliance with all terms and conditions of available defense and indemnity protections, including the prompt sharing of all documents and other information necessary or helpful to the defense and resolution of a claim or potential claim.
