It is the intent of the Governing Board to accept non-resident pupils and release resident students on interdistrict transfers under Education Code Section 46600 and under the Open Enrollment Act of 2010.
The primary responsibility of the Milpitas Unified School District is to meet the academic needs of the students whose parents or legal guardians reside within the Milpitas Unified School District. The Board recognizes that in order to meet this responsibility that it may not be able to accommodate all families and student requests for interdistrict transfers and that consideration of transfers should be done in a manner that is fair and equitable to all applicants.
Acceptance of non-resident students will be maintained at a level that assures resident students will be able to enroll in their neighborhood schools, allow for adequate scheduling flexibility at the middle and senior high schools and not place the district at risk of violating local class size agreements or maximums established by the State of California
