Subchapter 1. Equal Employment Opportunity Programs Article 1. General.Scope and Intent
(a) This subchapter implements and should be read in conjunction with Government Code sections 11135-11139.5, Education Code sections 66010.2, 66030, and Chapter 4.5 of Part 40 of Title 3, commencing with section 66250; Title VI of the Civil Rights Act of 1964 (42 USC ¬§ 2000d), Title IX of the Education Amendments of 1972 (20 USC ¬§ 1681), Section 504 of the Rehabilitation Act of 1973 (29 USC ¬§ 794), the Americans with Disabilities Act of 1990 (42 USC ¬§ 12100 et seq.) and the Age Discrimination Act (42 USC ¬§ 6101). Nothing in this subchapter shall be construed to conflict with or be inconsistent with the provisions of article 1, section 31 of the California Constitution or to authorize conduct that is in conflict with or is inconsistent with such provisions.
(b) The regulations in this subchapter require steps to promote faculty and staff equal employment opportunity which are in addition to and consistent with the nondiscrimination requirements of state or federal law. Therefore, compliance with these regulations or approval of the district's equal employment opportunity plan pursuant to section 53003 does not imply and should not be construed to mean that a district has necessarily complied with its obligations under any other applicable laws or regulations. The Chancellor shall assist districts in identifying other applicable state or federal laws which may affect district equal employment opportunity or nondiscrimination policies.
