(a) Commencing in 1998, each school district or county office of education shall notify the Superintendent of Public Instruction by May 1 of each year whether the school district or county office of education intends to participate in a program authorized by this chapter. By June 1 of each year, the Superintendent of Public Instruction shall, subject to the limitations of subdivision (h) of Section 47771.5, determine the maximum number of units of average daily attendance as calculated pursuant to subdivision (c) of Section 47771 that each participating school district or county office of education may claim for the following fiscal year for pupils enrolled in a program authorized by this chapter.

(b) To determine the total number of units of average daily attendance as calculated pursuant to subdivision (c) of Section 47771 that each school district or county office of education that has notified the Superintendent of Public Instruction of its intent to participate pursuant to subdivision (a) may claim, subject to the limitations of subdivision (h) of Section 47771.5, the Superintendent of Public Instruction shall make the following calculations:

(1) For each school district or county office of education that has notified the Superintendent of Public Instruction of its intent to participate pursuant to subdivision (a), determine the regular average daily attendance reported by that school district or county office of education at the second principal apportionment of the current fiscal year.

(2) Separately determine the total of the regular average daily attendance reported by all school districts and county offices of education in the state at the second principal apportionment of the current fiscal year.

(3) For each school district or county office of education that has notified the Superintendent of Public Instruction of its intent to participate pursuant to subdivision (a), divide the sum determined pursuant to paragraph (1) by the sum determined pursuant to paragraph (2), carry the results to four decimal places, and round to the next higher whole number.

(4) Multiply the quotient determined pursuant to paragraph (3) for each participating school district or county office of education by 9,000 and round to the nearest whole number. The resulting product is the maximum number of units of average daily attendance as calculated pursuant to subdivision (c) of Section 47771 for which a participating school district or county office of education may claim funding pursuant to this chapter for pupils who are enrolled in a program authorized by this chapter.

(5) The number of units of average daily attendance as calculated pursuant to subdivision (c) of Section 47771 that may be claimed by each participating school district or county office of education is that school district's or county office of education's actual average daily attendance as calculated pursuant to subdivision (c) of Section 47771, not to exceed the cap determined in paragraph (4) for that school district or county office of education.
