Students Expelled From Other Districts

The Governing Board may admit students expelled from other districts upon request as long as their admission is consistent with providing a safe, secure and positive school environment for all district students and staff.

Note: AB 922 (Ch. 974, Statutes of 1995, operative July 1, 1996 and contingent upon the appropriation of funds) amended Education Code 48915.2 to prohibit the enrollment, during the period of expulsion, of students expelled from school for offenses listed in subdivision (a) or (c) of Education Code 48915. Such students may, however, be admitted to a county community school, juvenile court school, or community day school established pursuant to Education Code 48660-48666. Before enrolling such a student after the term of expulsion, and before enrolling any student who has been expelled from another district for other reasons, Education Code 48915.1 and 48915.2 require that the district hold a hearing to determine whether that student poses a danger to its students or staff. It appears that this requirement for a hearing applies even if the admitting school is the middle or high school in a different district to which the student would normally progress after attending an elementary or middle school from which he/she was expelled at the end of the previous year.

In order to prohibit the enrollment of a potentially dangerous student, the Board shall hold a hearing before admitting any student who has been expelled from another district. If the student has been expelled for certain serious reasons specified in Education Code 48915(a) or (c), his/her enrollment may occur only after the term of expulsion, and only if he/she has established legal residence in the district or is enrolled pursuant to an interdistrict attendance agreement.
