Failure to Request or Receive Certification.

(a) A tenured faculty member who fails to request certification of eligibility in the manner and at the times required by this Article shall have waived the right to certification. The employment of an academic employee whose right to certification has been waived shall terminate on the first day of the calendar month next succeeding the month in which age 70 was attained unless age 70 was attained in an academic term or academic year in which case the tenured faculty member shall continue in active service until the end of the quarter semester, or academic year during which the employee attains age 70.

(b) A tenured faculty member who fails to receive certification of eligibility shall terminate employment on the first day of the calendar month next succeeding the month in which age 70 was attained unless age 70 was attained in an academic term or academic year in which case the tenured faculty member shall continue in active service until the end of the quarter, semester, or academic year during which the employee attains age 70.
