Identification And Education Under Section 504

The Governing Board recognizes the need to identify and evaluate students with handicaps in order to provide them with a free and appropriate public education. Under Section 504 of the Federal Rehabilitation Act of 1973, individuals with a physical or mental impairment that substantially limits one or more major life activities, including learning, are eligible to receive services and aids designed to meet their needs as adequately as the needs of nondisabled students are met.

The Superintendent or designee shall establish procedures whereby a parent/guardian or staff may request screening and evaluation for any student they believe to have a handicap that substantially limits the student's learning or engagement in school related activities.

A Section 504 Student Study Team comprised of knowledgeable professionals shall meet to evaluate the student. The student's parent/guardian shall be invited to participate on this team. The evaluation may include, but is not limited to, observations, performance-based testing, academic achievement information, and data offered by the parent/guardian and/or their representative.

If the student is found to have a handicap that requires services under Section 504, the Section 504 Student Study Team shall develop a written accommodation plan for the student. Upon reviewing the nature of the handicap and how it affects the student's education, the Section 504 Student Study Team shall determine what accommodations and/or special services and aids are needed. The handicapped student shall be educated with those who are not handicapped to the extent necessary to assure that the handicapped student's individual educational needs are met as adequately as the needs of non-handicapped students. The accommodation plan shall be developed in accordance with district procedures and consistent with the requirements of Section 504 and the Code of Federal Regulations, Title 34, section 104.

The Section 504 Student Study Team shall provide the parent/guardian with a written copy of the accommodation plan and notice of procedural safeguards guaranteed by law.
