Other Food Sales

The Superintendent or designee may permit food sales by student or adult entities or organizations provided that these sales are in compliance with state and federal regulations so as to ensure optimum student participation in the school food service program. Such food sales shall not interfere with the food services' ability to be financially sound.

Sanitation and safety procedures shall comply with the requirements of the California Uniform Retail Food Facilities Law as set forth in Health and Safety Code 113700 et seq.

At least 50 percent of all foods offered for sale at any school on any school day by any student or adult entity shall be selected from the nutritious foods listed in Education Code 38085 (See Exhibit 3554(a))

Use of Outside Food Vendors

Under the direction of the Superintendent, the principal or designee at each school shall assure that foods sold on school premises by outside commercial food vendors comply with the requirements of the above policy.
